Instructions For Filing an Expungement

The attached form must be filled out in it's entirety. If you do not know the Case Number, Section or Judge, please leave the space blank and our office will provide that information.

The form must contain the date of arrest, arresting agency and the exact offense(s) and charge(s) you are requesting to have expunged. If you are unable to provide this information, contact the Louisiana State Police to obtain a copy of your arrest record.

Four separate money orders, issued by the U.S. Post Office, are required and each must be issued in the correct amount. If not issued in the correct amount, all four money orders will be returned.

You must advise this office of any change in your address. Failure to do so may affect your notification of the expungement order. A certified copy of your expungement order will be mailed to you upon completion of the expungement process.

Information regarding the status of your expungement will not be given over the phone. No one other than yourself or your attorney will be given status information. Inquiries must be made, in person, with proper identification. Attorneys may request the status of their clients expungement by faxed letterhead. Our fax number is (225) 389-3373. You will be sent a certified copy of everything upon completion of the expungement. Please retain this information for your records, as this will be the only copy supplied by the Clerk of Court.

As per La R.S. 44:9(K). The following applicants for expungement shall not be required to pay any fee to the clerk of court, the Bureau of Criminal Identification and Information, sheriff, the district attorney, or any other agency to obtain or execute an order of a court of competent jurisdiction to expunge the arrest from the individual's arrest record if a certification obtained from the district attorney is presented to the clerk of court which verifies that the applicant has no felony convictions and no pending felony charges under a bill of information or indictment and at least one of the following applies:

(2) The district attorney consents, and the case against the applicant was dismissed or the district attorney declined to prosecute the case prior to the time limitations prescribed in Chapter 1 of Title XVII of the Code of Criminal Procedure, and the applicant did not participate in a pretrial diversion program.

(3) The applicant was arrested and was never prosecuted within the time limitations prescribed in Chapter 1 of Title XVII of the Code of Criminal Procedure and did not participate in a pretrial diversion program.
